    Well thats a new one on me.

    Normally they insist on account being closed.

    I suspect that Anita may be mistaken and they will close your account anyway, but hey ho let's give it a go.

    I still suggest that you ask them to clear the outstanding balance on the account down to zero. Maybe just leave out the bit about closing the account.

    In which case email would look like this.

    Dear Rachel,

    Thank you for your email dated ( friday ?). I look forward to receiving your revised proposal, for settlement of my County Court claim No xxxxxxxx by 5PM on Monday 7th December by email.

    Further to our recent communications I am prepared to write to the County Court advising them that settlement of my claim has been agreed with the defendant, provided that that you increase your total settlement figure to £2629.04 ( = £2430.30 +8% ) and that from this revised total settlement figure you will deduct the amount required to clear the outstanding balance on my account back to zero. I also require the remainder of the settlement proceeds to be transferred via BACS so as to reach my bank account ( sort code xxxxxx, account number xxxxxxxxx, Account name xxxxxxxx ) before close of business on
    Friday 11th December 2009.

    Rachel, you are no doubt aware that I am ordered by the Court to submit an Allocation Questionaire by the 11th December 2009. Should you fail to carry out my above requests then I will have no other option than to proceed with submission of the allocation questionaire and proceed with my claim as originally particularised.

          That what I thought; the figure being too much! what she playing at lol, thats why Iasked you hun. I did originaly send her the email you sent me she obviously didnt add it properly.....

          She is obviously keen for my answer as she just sent me this:

          Dear Angela

          Further to my previous email, we are prepared to offer a further sum of £228.74 for the statutory interest on your claim. This is offered in full and final settlement of claim number

          Please let me know whether you accept this offer. If this offer is accepted I can arrange for a bacs payment to be made to you. However I cannot guarantee that this will be received in your bank account by 11 December 2009. Whilst I cannot guarantee this, I will endeavour to get this to you as soon as I can.

            Hi Flangies,

            Pop her an email back.

            The exact figure you require is £2624.72
            ( not £2629.04 as I put in the draft email - must get a new calculator LOL )

            This is an additional £194.42 (8%) compared to their original offer of £2430.30

            Suggest to her that if she has calculated it as an extra £228.74 then you would be happy with that. IE £2430.30 + £228.74 = £2659.04

            Remind her that you must have her confirmation by 5pm tonight

              Lets hope I dont have to wait too long for the money either,she mentioned possibly not getting by 11th - dont want that dragging on lol

                Lets see what she emails you back with LOL

                You dont need to do anything with the Court until
                1) You get the email from her, we will then write a letter to the Court saying that a settlelemnt has been agreed but you need to allow some time for settlelment to be effected ( payment to clear etc ) before stopping the claim.
                2) Once payment cleared and you have statement confirming balance of account redcued to zero ( or closed ) then you can write to the Court stopping the claim.

                When she emails back to you just send email back thanking her saying that you accept her offer. Advise her that you will write to Court informing them that you have reached a settlelemnt and that you will discontinue claim at the Court as soon as funds in your bank account and balance on your account reduced to zero as agreed.

                All in all it appears to have been worth a couple of emails for an extra couple of hundred pounds plus it looks like you will have some dosh in your account by beginning of next week latest.

                    IMHO
                    Cap 1 have changed their MO recently so long as you have "maintained" your account they will pay up without affecting the account balance.

                    Where as in the past they chose to be a bit spiteful and close your account down for having the audacity to claim back your penalty charges they now realise they are now standing back and thinking:

                    why should we drive the business away?

                    after all people who are prepared to push their accounts to the limit are surly the best customers they could have.

                    Thinking about it...they're bang on the money but obviously the first debt you need to clear is the one attracting the highest rate of interest. Good on you !
                    The charges coming in to the banking industry every day will more than pay the banks total legal bill for the whole test case so why wouldn’t the Banks want to "ensure Justice at the highest level"

                        Update- just checked my Cap One account online and theyhave cleared my cap one account to zero. Excellent

                        However please see below balance amount:
                        Current Balance -£1,478.49
                        Credit limit is £1,000
                        Amount overlimit £0

                        How can the current balance be -£1,478.49 ??

                              Is £2430.30 the amount of your charges plus Int that you have asked be returned?

                                Yes this is the amount we have agreed that I get paid although I pushed for another 224 .00 as stat court interest and that was agreed too. Also I was told I would be gettin a cheque for the 2 430 quid and would get the stat int by bacs into my bank. And I then asked for it all by bacs into my account after they cleared the cap one balance!
