    got nothing to lose asking for extra 8% have I? they will either say yay or nay!!

    I think I would just feel out of my depth if they started making a fuss and asking for evidence etc .

    If they do agree then do I nee to go back to the court to change details or will cap one make amendments to thier offer on paper??

    It is not often I get good news and I got £150 being rfunded from GMac too..... :tung:

        You are right, you have nothing to lose.
        See my earlier post for details of what to say.
        She will not make a fuss or ask you for additional evidence, she will probably just be glad to tick another court claim off the list.
        Bear in mind that they are trying it on with you because they know full well that if you took it all the way they would have to settle up your claim for compound interest in full.
        I don't think they will make a fuss or ask you for additional evidence.
        You dont have to do anything with the Court if Cap One add the extra straight 8%, all the Court are interested in is whether the claim has been settled, they do not care about the detail.

        If / when she agrees just ask her to confirm the final figures with you via email, agree verbally that you will discontinue the claim as soon as account balance is cleared, account is closed and you have received and cashed balancing cheque. They will actually pay the balance directly into a nominated bank account by BACS transfer if you ask them ( quicker ).

        Practice what you wish to say before you phone and I am sure you will be fine. If you get at all nervous or worried during the call just say that you need to think about things and ask her to call you in an hour to discuss further. Gives you time to get your nerve back.

          I dont know why I am being so silly about calling; I speak with radiographers and other officials in hospitals everyday an they are sooo difficult at times; get a grip Angie

                  ok well after trying to get through to the call centre staff who did not understand the name let alone what I was talking about! I eventually spoke to a lady called Anita from customer services team and I asked to be put through to Alana Swain. I was told that she hadnt heard of her, so i explained she works int he response team and she ahd sent me the letter etc etc. She had my details so knew exactly what I was talking about. She couldnt put me through directly she said to that team....... So I told her what I wanted and she asked me to email through my capital one log on with a secure message for ALana attention, which I did... they have two days to respond to me, I also asked Anita to email Alana or someone in the Executive reponse team give them my number to call me, briefly outlining my message/request.

                  I was also given a long lecture about keeping my account in order moving on in the future etc etc, how if the account got closed through myself or cap one it would be hard to get another credit card in the future!! She wished me a lovely afternoon and thanked me for calling cap one........ I felt like a child lol

                    She is on the same team as Alana and should be able to put you through to Alana or assist you.

                        Hello Just spoke with Rachel Howey and she asked if I had put that I wanted stat court interest at 8%; I said well I believe I did Rachel. Need to check that now Budgie to see if I did. Anyways she is going to ahve aword with her manager and email me over the weekend or call Monday with an answer. I also asked for BACS payment.

                              If she has then let me know what she has written in her email and we can compose a fitting response.

                              If she hasnt then I suspect you will get a call on Monday.

                              You know that you have actually claimed compound interest in your court claim not statutory court interest. You can tell her this. She already knows too, she isnt silly.                               You are basically letting her know that you "might" be prepared to drop the court claim provided she adds an additional flat 8% to the total figure they have proposed. The reason for requesting this is that you have become aware that the way Cap One normally try to settle claims, once they reach the court stage is the way that they have done so with yourself, but that you have seen similar letters to the one they have sent you and in those letters Cap One have added 8% on top.

                              Keep it simple, don't get into a discussion or argument with her, and don't threaten that you will continue the claim if she doesn't agree, say you are considering matters. Try and keep it all nicey nicey ( she is actually quite nice to talk to, I had loads of chats with her throughout the course of my own claim -LOL. Sort of pretend that you dont understand why someone else with a similar claim would get 8% extra on top and you havent !!

                              If she says something like, if I add 8% on will you agree to settle then don't say YES over the phone. Ask her to confirm it via email and say that you will get back to her asap.

                              What we are doing here isnt strictly the way I would normally recommend a Claimant conducts themselves in a Court claim.

                              However, I know that you are pretty keen to resolve this matter quickly and dont really wish to carry on for the additional amount that a succesful compound interest claim would get you ( after about another 6-9 months and several court appearances ). So this is just a little bit of tactical manouvering to try and squeeze every possible extra penny out of your claim.

I didnt say I would take it any further if she didnt agree.... and I wouldnt threaten with it or metion it if/when we spk with her again. but I said I wanted her to let me know their offer via email as you suggested and I would consider once I recieved this in writing. She said she had to check with her manager first, so I said well for her to go ahead and do this firstly.

                                I thnk the fact that I was a little nervous as you know about calling; and I came up with getting the other lady Anita who tried to give me a lecture about moving forward and keeping my account in order! lol and the fact she couldnt put me trhough to the executive reponse team or Alana.....BUT I didnt get into much of a conversation with her though, I then emaild and didnt get anywhere with that, then left 2 messages for Rachel before getting anywhere..... I hope I havent mucked it up!
