  • Please Help , Advice on Asking For Proof Of CCA/PPI claiming

    Hi,

    Can someone please help,

I had an MBNA card that was in a repayment plan, after about 6 months they sold it to a debt recovery agency, when the DRA sent me the bill they had the incorrect amount as i was in dispute with MBNA as to incorrect interest . I told the DRA this and they were quite rude to me.

On the 02/09/2013 a written request for a true copy of the CCA was sent to the DRA, i recieved a letter from them on the 7/10/2013 stating they were investigating to obtain original documentation.

8/11/2013 I received a copy of 12 months statements but no CCA.

10/06/2014 I received a letter to say the payments i had been sending to mbna had been forwarded to DCA, i had not been making any payments. Still no CCA.

3/6/2014 I receive a letter from the specialist collections team of the DRA, saying that i owe them the outstanding balance.

17/06/2014 received a letter saying the DRA will search my credit file,(which they did without my permission), search to asses home ownership, any assets, employment verification.

1/07/2014 I sent another request for my CCA recorded post this time, stating this was the second time i had sent the request.

03/07/14 I received an illegible copy of a CCA with what looks like my signature on it, its next to impossible to read and is a photocopy of a photocopy, along with 12 months statements.

The account is an amalgamation of 2 mbna accounts, which mbna put togather without asking me around 2006, one of which (not the illegible CCA that was sent) had ppi on it, and i know that there were fees of over £12 on both accounts, can i reclaim this money? And the DRA are threatening to take me to court, which is quite worrying. The debt on my credit report says settled with mbna, no mention of the DRA at all, i don't know why.

At the moment the DRA have frozen the account for 2 weeks, and to be honest i don't know what to do next.

    Any help would be appreciated.

    Thank you,

    Onion.
