    Just a quick thought. Have you ever actually requested a refund of the PPI and charges etc? Cos if the PPI didn't cover the payments for whatever reason then you might have a case for mis-sold PPI? And as for charges, I found MBNA ridiculouslyeasy to get charges back from, in fact the amount we ended up with was about twice as much as we'd actually been charged, I think. I remember thinking at the time that god only knew how they'd arrived at the figure cos we'd been paying by dd for years so there couldn't have been many charges anyway lol.

    I know you'vegone down the CCA route but that's not making it go away, is it. Charges and PPirefund might significantly reduce the balance etc.....

    If I am talking round my hat here then please feel free to tell me lol.

      PPI misold with some Solicitors from consumer net which OH done a while back as account in dispute charges also.

          Received a batch of papers from MBNA, incl a "SIGNATURE FORM"" , page for a MBNA CCA, the wife states that she has never seen any of the so called paperwork they have copied and sent, including the signature form which seems to have her signature on it??? signed / dated 04/2003.

          This was a THOMAS COOK Card from over the phone, which she had understood to be a loyalty card initially when she accepted over the phone, also to be mentioned a letter from MBNA quite a few momths after CCA request that Quote: -
          "We note that the account was acquired from another lender some time ago. As such we need to obtain documentation from that lender. As soon as we receive that documentation we will forward it to you in response to your request."

          so how can the signature form just mention MBNA only???

          Have sent e.mail to admin with copies of the said documenets, as unable to download myself, comments from Curleeyyyyy anybody please.

                That'll be missing the prescribed term of rate of interest (APR) then
                Yes there are examples, but none of them tie up with the credit limit applied.
                Possibly payment terms as well.

                Also appears to be unexecuted.

                Typical MBNA.

                  Which letter response would you suggest i.e. pointing out non compliance, also item in acquiring the debt from another lender, but some how showing a MBNA signature form, which the O.H says she has never seen???

                        O.H has received a letter 2nd class from Experto Credite saying they have bought the interest of the MBNA account (credit card) and that they are now the legal owners, ( no letter from MBNA to the effect yet), so it would seem MBNA may of sold a disputed account??? what next folks?????:beagle:
                        No reply from MBNA to letter sent 11th May 2010, non compliant CCA also included last para quoting welsh minister etc about if do not have CCA in compliance they must state so. No DN received up to to-day, no MBNA correspondence regarding selling alledged account to Experto Credite.

                            Received 2nd letter to-day from Experto Credite for OH, have prepaired response (Curley!s letter) to send off after week end. Still no information from MBNA saying account sold or DN.

                              Sent off letter to Experto Credite on Monday 21/06/2010, received to-day 23/06/2010, recorded delivery signed for (more like a squiggle showing a race circuit - I thought my signature was bad.

                                O.H. received to-day a letter from Experto Credite which says: - We write to confirm receipt of your letter dated 21/06/2010.

                                We have requested a Notice of Assignment from MBNA (according to their original letter Varde Investments had bought the interest of MBNA), Please note the account will be placed on hold and no further activity will take place until the information has been received. Upon receipt, we will forward this to you. (What are they on about ? Curley!s letter was what was sent regarding OFT Guidence etc).

                                Should we experiance any delay in receiving the information, we will of course refer to you. Yours Faithfully, K. Breen

                                OH has not received any other correspondence from MBNA since letter of dispute sent to them in May 2010, quoting Welsh ministers etc.?
