  • I'm not worry worrying if ya know what i mean..... more angry......frustrated.......confussed as to why they are not following the same proceedure that they have with everyone else. I'm hoping my case is strong enough to be decided upon regardless of this OFT test case...but I'm not holding my breath.

    I'm wondering if I can request the telephone reccording of my conversation with the bank on the 5th june..... the one where I was informed a loan was my ONLY option!! as evidence i was forced into taking a loan out...to stop them from taking anymore of my benfits!!!

    is this a plauseable request? if so how do i go about it?

        • Just an after thought Tempty when you ring your court on Monday, just ask is it known how things will be affected there with this new OFT thing. As was said earlier tis up to the individual courts what they are doing, they may tell you that cases aleady in will carry on.

            let's hope so eh...... i want me bloody money...... i would like to press charges against nasty west for the forced loan too..... but i don't think i'll get anywhere with that one! I'll settle for getting me money at this point!
            just get a nasty feeling it's all gonna go tit's up on me though....these things usually do.....lol dunno what i did in a previous life...must ave peed someone off though

            • You'll get there Tempty I am sure, feel sorry for those who have been thinking about doing it for a while and not got on with it. Can't see how the banks can come out of this on top, it is so obvious that their costs are no where near what they charge and that I think is the whole crux of the matter.

              • yup I know what you mean, if I'd have known I would have done hubbies at the same time.... think that one is a no hope'r now even before it's got started.... been requesting the info for 3 weeks, still not received anything but I wanted to go further then 6 yrs on that one. I was going to go back to 95 on mine too (when i opened the account) but does'nt look like it'd be worth it now!
                I'll just be happy to get this back though in all honesty... Yes it would have been nice to try for some sort of compensation for this loan i'm forced into... it would be nice to get the 8% in interest too.... but at this point i would settle for charges only....pay off the bloody loan and close the account! I just hope i get the chance to get even that amount back.
                I'll push as far as i can go mind you...I'm not giving up on the fight! I'm just not looking at it as a sure thing anymore!

                • Right after a morning of having the phone attached to my ear and getting nothing but the engaged tone, I finally got through!!

                  The date for the bundle stands.... so deffinatly has to be in for the 14th August. I can however add any corrispondence between myself and nastywest/coblers right up untill the court date itself..... just not anything else.

                  They had made a mistake in not charging me the allocation fee and will send out a bill for the fee and another exemption form! good job thanks to you lot I knew enough to queery that..... could well have gotten to court and had it thrown out on the bassis no allocation fee had been paid!

                  For goodness sake I know the courts are swamped But I really do think we claiments have enough to worry about with this OFT case going forward possibly stalling our cases, without having to worry that the court system itself is going to stuff it all up for us aswell!!!

                  oh well rant over..... problem has been solved so onward and upward....for now. (hope wendy's natwest girlie is right about existing claims still going ahead) Think I'll start to tackle my Bundle over the next few day's! Keep an ear open folks.... I may need to shout

                  • I've been at it on and off all morning it's orrible, I have printers bloody phobia lol. Most of my stuff is supposed to be coming from Delta, I have to send the DG one off tomorrow, i just hope it comes as i am working tomorrow too and won't get time to do it lol
                    I think I have done the rest of it, I keep ticking things off and putting them in order well supposed to have. It'll all come together I hope:rolleyes:

                            • yeah got my court date for 23 Oct, but my bundle has to be in for the 14 Aug. no idea why...but that's what the judge decided......lol
                              they also compleatly forgot to charge me the allocation fee....I had to ring em up to remind them, just so I can compleate another exemption form anyway

                              • Might sound daft this Tempty but your date for your bundle, maybe it is because if they don't comply as is the norm!!!!!! you can then ask for judgement and get it over quicker, just a thought I had, what do you think?
