At the defence stage it is not uncommon for Cobbetts to issue a CPR Pt 18 request, only the court can issue this and therefore this has no bearing on your claim. I would send this off to Cobbets, also run a copy off for yourself and another for the courts to be included in you Allocation Questionaire.
Dear Sir/Madam
Case No: xxxxxxxxxxx
I Acknowledge the receipt of the defence posted on behalf of The Royal Bank of Scotland.
At this moment in time I am not prepared to answer these questions. I anticipate that this claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative.
Furthermore I consider that the CPR part 18 request is intimidatory and I intend to bring this to the notice of the court. However, as a gesture of good will, I confirm the charges I am claiming were applied to the following account:
Account Name: xxxxxxxxx
Account number: xxxxxxxxx
Sort Code: xxxxxxxx
Please also find enclosed a breakdown of all charges I am claiming.
Yours Faithfully
