      Excellent, I've been thinking about you and how to contact you.

      With regard to your MBNA card, who are the "solicitors"? They are probably more DCA than solicitor.

      Do you have statements for this card, do you know how much they owe you in charges?

        Thanks Amy they are RESTONS (in cheshire) i have some statements i think the charges are about £1500-00 ish ??

          Do you mean the charges amount to £1500 odd with the statements you have? If you do not have them all you should send them an SAR. Or have you already started to reclaim these charges?

              Subject Access Request (asking for all the information held on you which they are obliged to give you for a £10 maximum fee under the Data Protection Act 1984)

                  They don't have to send you your statements, but they do have to provide you with all the information they hold on you and that should include all the charges but maybe in list form.

                  As long as they provide you with the information you have requested, it doesn't matter what form it takes.

                      Judy, in the first instance I would send a CCA request to Restons, but I'd like to know what communication you've had from them too.

                      Dear Sir/Madam

                      ACCOUNT NUMBER: xxxx

                      Please be advised that I do not acknowledge any debt to your company.

                      I request that you send me a true copy of the credit agreement relating to the above account before I will correspond with you further on this matter.

                      This is my right under the legislation contained within section 77 (1) and section 78 (1) of the Consumer Credit Act 1974, and I am entitled to receive a copy of my credit agreement on request.

                      Your obligation also extends to providing me with a statement of account. I enclose a cheque/postal order for £1 which is the statutory fee payable. A copy of my credit agreement should be supplied within 12 working days from the date of this letter.

                      As I'm sure you will be aware, creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

                      Also, I request you supply me with a signed true copy of the executed deed of assignment for the above referenced agreement. This is an obligation, whether you are the original creditor or not, under section 189 of the Consumer Credit Act 1974.

                      Take note that any legal action you may contemplate in the interim will be both vigorously defended and contested.

                      Please ensure that any contact by you is made in writing only to the above address. Telephone calls will not be acceptable.

                      I look forward to hearing from you within the statutory time limit.

                          i have done the letter to RESTONS (mbna) and also one the the bailiff, also spoke to ronan this morning (he called me) so should know within the next few days if i get an offer i will put it to you for your advise if thats ok ??

                            Thanks i called the mbna and asked for SAR but told me that i would only get the last 6 months statements the rest i would have to pay £4 a statement what a joke, she was not a very nice lady at all , what should i do now??

                              The person you spoke to is not only an idiot & nasty piece of work but also has no understanding of the law.(or pretends to)

                              Send your SAR (subject access request) + the £10 statutory fee (which is all that is required by law) & they'll send you the data & if they don't you tell them you WILL report them to the Information Commissioner

                              Finally NEVER EVER speak to them on the phone.......unless you can record the conversation because they WILL lie when confronted with their blatantly false & misleading statements. You must put ALL communication in writing

                                Many thanks, what address do i need for that also have been with mbna about 13 years am to ask for all the statements or is SAR something else getting a bit confused ??
