Re: Fendyweather -v- Natwest Round 2

Hello and Boo to y'all, right on account of I have had a bank charge, ok, if Im honest, and lets be............... its my own fault. But it was an accident. As you all know I send off the prelim letters etc. etc. etc. followed the procedure for claim number 2 early last year, but when the whole case thing was put on hold pending this claim with the OFT, etc. I decided to leave things to settle and wait for the outcome before filing at court. STUPID ME........................ well, yesterday I realised my account was going to overdrawn for the first time in over a year, so rapidly went down to bank to pay in money for a bill I knew was coming out that day, Friday 16th Jan and one on Monday 19th Jan. Well, stupid stupid stupid stupid me, what did I do, paid the flippin cash into my daughters Natwest account by accident. How thick can one girl be. My excuse is, and its genuine I had a manic manic day yesterday and just wasnt concentrating, so my mistake yes, but when I checked my account online this morning Ive been charged £35 and £38 quid. I appreciate one is for the dd they were unable to pay yesterday because I paid the money into the wrong stupid account (my fault), but then the £38. Any idea what the second one might be for ??? (Nattie) ?

I rang them to explain my error, admitting it was my fault but could they look at it kindly and refund due to my error, PLAIN ANSWER, NO............................. no help, no nothing, nada. So thats it, blood a boiling again now, so where does it leave me with regard to filing at court now and not waiting for the outcome of the test case. Ive calculated the spreadsheet again, with the new charges on it, (last time I sent them prelim and LBA), it just had charges from 2000 to March 2008. Now I have some more from 2009 courtesy of my muck up yesterday, I am adding those to the sheet and filing at court Monday Ive decided. I just wanted to check with those more in the know than I, even though Ive waited this long from last March since LBA and prelim etc. is it still ok for me to file now and not wait ? MY BLOOD IS BOILING. Oh and BTW I changed my account from Advantage gold last November to Regular Current Plus and saved myself £12 a month as I just wasnt using any of the so called advantages of the ADVANTAGE GOLD.

    Ta muchly moo mi peepies.

Fendy, £35 Guaranteed card payment fee?
I wouldn't file at court. The FSA Waiver is clear, that the claim currently on hold and which you may well be getting updates from time to time is 6 years from that time, me thinks you need to send a letter to add em onto the existing one

Ta Nuttie, but it was a direct debit, not a cheque that I wrote with my card ??? So what the heck is that all about................................ I know the 38 is for bounced direct debit, but I never used my card to guarantee any payment so what is that all about............And dont file yet ? That is the order of the day yes. Still !! !!!!!

Fendy, what does it actually say on the statement with regards to the £35 charge, you sure you are not reading the bit that says what the item being returned is and the amount?

              Hello Nutty............... its says
              CHARGES £35
              CHARGES £38

no explanation whatsoever................. I do know one is for a bounced direct debit of £48.50 to my hubby car insurance peeps.......... I will just repay it to them on Monday, but I really dont know what the other is for, and only explanation is CHARGES.

thats it.................... I think it warrants a phone call on Monday. I just hate speaking to them cos they get me so mad and het up. Their bad manners and plain impudence just infuriate me and I could well do without the raised blood pressure at mo to be honest. xxx

Surely it says more than that, have you looked at transactions over the last week and not the front bit which just has the mini statement bit?

I see what you mean now....................... lol lol lol, however its still not right because..................

OK Nattie, on 14th Jan I had balance of -£695.76. (I have use of overdraft up to -£1500) so then using my maestro card I made a payment to myself, i.e via HIFX to my french bank account of UK £590.22 which made the balance -£1285.98, then two further direct debits came out taking me to -£1577.93. But then on the 16th it says GTEE CARD PAYMENT FEE POST 590.22 HIFX ONLINE.CO.UK and the charge of £35. But at the time I paid that from my account with my card was on 14th and there was enough balance on the account to be able to take that money, yet theyve only charged me on the 16th after its gone over the limit. surely that doesnt make sense in charging me because at the time the money was paid on my card it didnt take me over my limit. I can understand the CHARGE OF £38, thats obviously for a dd that took me over the -1500 overdraft limit, but to have charged me for the first transaction surely is wrong and invalid when it didnt take me over my limit on the 14th, its only because of the subsequent direct debit that went out after that two days later that it took me over my limit if you see what I mean. How could my maestro card have allowed that payment to go through then charge me two days later for it having taken me over my limit but only because in those two days another two direct debits came out. Im puzzled. It still doesnt answer the question really. Aghgghghghghg

Needless to say Ive now put in over a grand to take it well back below its limit again but why did they charge me for the transaction which took place on the 14th which didnt take me over my limit, then two days later they charge me 35 for it but only after two other dd's have taken me over my limit. It is based on when the transaction is actually debited from the account and not the day it was made. I suspected it was a Guaranteed Card Payment Fee.....
