    I was referring to the apparent offer to drop the improper criminal charge if all the monies demanded by the bailiff (including any and all improper or inappropriate fees) were paid to the bailiff.

    At the very least, that does seem to show a quaint view of justice.

      I am of the opinion that Fraud by False Misrepresentation has a better chance of proof than Theft. It also carries a heavier penalty on conviction.

        Yes I did get her badge number. I have her badge number and name on a letter she posted through my door yesterday saying she needed to speak to me.

          Many thanks for clarifying that, CC. Under those circumstances, that would be Blackmail. The officer who uttered that could lose their job at the very least. If the bailiff encouraged them to say that, he/she is in very serious trouble. Losing their certificate, which is likely to be a foregone conclusion, is going to pale into insignificance. If this goes to court and the muppet is convicted, they could face a lifetime ban from holding any post in civil or public service on top of any other punishment.

            sorry its been a very long day, i will read through all of these posts properly tomorrow.

            I feel like a criminal!! Arrested, in a cell and my home was searched while i was at the station.

            Like the police haven't got better things to do than arrest me!!

              Looking at how the police have aided and abetted the bailiff, I hope they will see the error of their ways and realise they are up for paying out a claim for wrongful arrest and unlawful detention, let me see £5 10k if they are lucky, along with possible criminal charges for their officers in this sorry feck up.

                          Also the police woman agreed that I do in fact need my car for work. She has now suggested as I am not able to go to work as I have no car to look for a job in a residential home!!

                          How is this meant to help my present situation in that I can't go to work on monday or in the near future and I will need to catch 8 buses a day to take and collect my children from school???

                          Also she informed me that my car may not cover the costs so the bailiff may come to my home to take other goods

                            It is, however, something else for "Professional Standards" to consider.

                            If the sale price would not "cover the costs" and pay off a substantial proportion of the money owed, then it was improperly levied mainly or solely for the bailiff's benefit.

                            It is a pity you do not have a recording of that future lollipop woman saying that.

                              Exactly so, Improper levy the police have been rather silly here, it is the bailiff they should be investigating ior criminal actions.

                              By taking the car, they have prevented Kim from working, therefore made discharge of the debt almost impossible, surely that isn't justice, marstons and police hang your heads in shame, is this not an action likely to breach Article 3 of the European Convention on Human Rights as it is Cruel and Inhumane Treatment, tantamount to torture? And way beyond any original fine or sentence in it's impact? Which also then brings in Articles 4, as the enforcement is effectively a sentence without a proper hearing, and 8 where the right to a family life is impinged due to effect on children, .

                                I agree - making it harder or impossible for a debt to be discharged was the reason why debtors' gaols were abolished in the nineteenth century.
