Marston bailiff clamped my car!!

    You should be OK then, in any case if he just clamped it and ran, and left no notice of seizure you can assume it wasn't actually seized, in which case it and in any case it has not been stolen sio the bailiff has lied to the police, in order to put you under undue duress, either way so long as you pay when you said you will there is not much he can do.

      I see no reason why you shouldn't use it. If you're afraid of being stopped for driving a stolen vehicle, take your driving licence. The police can soon tell whether it is yours and whether or not it is insured, so I wouldn't worry too much about that.

                The OP has a defence that they genuinely believed the bailiff had removed the wheelclamp due to his non-compliance with correct legal procedures, i.e. no Clamping Order.

                  Strangely, that's what a lot of police officers called the CPS when it first came into being. The other one was the Clown Prosecution Service, due to the inept and incompetent way in which CPS handled cases in court. It could be excruciatingly embarrassing watching CPS completely mess-up a case in front of a magistrates court.

                          Hi everyone!

                          Well just a quick update and question for you all.
                          I haven't heard anything more from the policeman or bailiff. The bailiffs certificate ran out on 17.01.12!! I am still yet to call the court and see if he renewed this but I highly doubt it if the register has not been updated in a year!
                          i have today tried to make a payment to marstons for the fine but when I put in my reference number on the automated payment number, it is not recognised! Does this mean my account has been passed back to the court?

                            You need to inform the court tomorrow of Marstons preventing you from paying the fine. Better still, refer this directly to the HMCTS Regional Contracts Manager. Don't bother with the HMCTS Area Enforcement Manager. This is an unsavoury and potentially illegal tactic of Marstons whereby they engineer an alleged failure to pay in order to justify forcing entry to a fine defaulter's home and boost their fees. I am sorely-tempted to bring this to the attention of the Head of Enforcement Operations for your area. Who are your local police force, please?

                              Bluebottle, this needs stomping on yesterday, Marstons if they are obstructing Kim481 from paying her fine, just to garner fees and engineer forced entry, MUST be removed from the enforcement industry forthwith. BUT HOW?
