    The bailiff is being an anus, A long as you have not disposed of the car, and are using it as per a walking possession, where the goods are being used normally whilst being security for a payment arrangementthen really he is guilty of wasting police time imho, as if clamping a car prevents the debtor earning a living and money to pay the debt it is counter productive, it is disingenuous to say that tough get the bus, if the shift pattern is such that public transport is not available.

      Thanks bizzybob - I have not had a walking possession agreement with the bailiff, he just clamped the car. I am a home help assistant who travels a great distance from my house for work and has to travel between clients and this can only been done by car. My children also go to school across the other side of town (due to no school places in my area) and it would take 8 buses a day to drop and collect them everyday. I have explained to the policeman that without my car I can not do my job and therefore no money to pay the debt.

        Hope bluebottle comes in regarding this, but i suspect the policeman you spoke to will see that the bailiff is trying to be a complete anus, and his clamp would prevent you working to pay the debt, mnotwithstanding the clamping of itself may have been unlawful. Unless you sell or dispose of the car, and until such time as the bailiff gives you a Notice of seizure listing the car, how can it be stolen if it isn't seized?

        If i was that copper i would be telling the bailiff, his yarbles are in danger of removal, in a very painfull way.

          The car had been only been seized by the Bailiff, meaning it still belongs to you but under the control of the Warrant, as no WPA was in operation then you are free to use it as you see fit. If the car had been removed then yes it could have been classed as stolen. Another classic example of a Bailiff twisting things to get the no knowledge Police on his side.

          If I remember correctly he only has a Warrant of Execution, a Clamping Order is yet another specific Order from the Magistrates Court and not part of the WoE per se.

            I wonder what Mr Plod the Policeman would do to Mr Scumbag the Bailiff if he found out Mr Scumbag had been telling him porkies? Something excruciatingly painful one hopes. If there is no Clamping Order, hanging him by the gonads from the police station roof might provide the police officers on duty with some amusement during their shift and teach the bailiff a lesson that you do not p*ss-off or lie to the police.

              Hopefully put his cordwangle in a thumbscrew for lying to police and wasting police time, among other crimes. Or better still feel his collar and get him up in front of the beak

                No, bb. Hanging him by the gonads from the police station roof is much more fun. Whether CPS would put a certificated bailiff up in front of a magistrates court is another matter. They came out of a criminal appeal very badly before Hove Crown Court just before Christmas because Sussex Police acted on the say-so of two neanderthal bailiffs acting for local authority whom, it transpires, had obtained an LO wrongfully and are now trying to heap blame on the innocent person whose home to which the neanderthals illegally forced entry.

                  Perhaps CPS should make an example of a certificated cretin, and throw the book at him, preferably a big heavy one, say a large print version of War and Peace, or send him to jail where he would have to go on the segregation wing with the nonces, who would whirdle* and scrope* him to within an inch of his life.

                    That sounds incredibly painful, bb. Not being a sado-masochist myself, I can only imagine that "whirdling" and "scroping" involve the infliction of excruciating pain.

                        Well you have all put a smile on my face with your comments and I had a little chuckle. I haven't heard anymore from the policeman yet so I can not update on the situation. In sure he had better things to do with his time!
                        Do you think I am safe to drive the car as he said it is reported stolen and I have to take children to school tomorrow and go to work? Should I take my v5 and insurance documents with me as proof of ownership?
                        It is ridiculous I feel uneasy and unsafe in my own home and I am scared and worried to drive my car!! All because of a few missed tv licence payments!

                          Did the policeman, say you could not drive it?, take your insurance docs with you, but I cant see any reason why you shouldn't drive the car, as the bailiff hasn't even given you any notice of seizure, if you were stopped and arrested for theft, you would be in line for a claim for unlawful detention, and the bailiff would have some explaining to do.

                                The policeman has not said I can't drive it. It was a brief call with him as he was dealing with something important at the time and he said he would call back. That was at 11.30 but I haven't heard anything back from him yet
