Marston bailiff clamped my car!!

    Thanks cleverclogs

    I now have a NFA which is good but I am also without a car. I tried to explain about the bailiff and the non existent clamping order and the fact that he does not even appear to be on the bailiff register but they said I committed a criminal offence and had to hand over my car

      Kim,

      I am going to bring this matter to the attention of Celestine. This may need to be pursued with Marston's CEO and, possibly, HMCTS at high level.

            It could even be excellent, as it suggests to me that those stupid worzel-heads already knew that no offence had been committed.

            Utter nonsense.

            Sue the Chief Constable for the return of your car, as well as seeking damages from the plods and Marstons for wrongful arrest and false imprisonment.

            If Marstons starts to lose money because of the antics of its morons, they might start to improve.

              No because the woodentop thinks that marstons bailiffs by collecting for HMCS are as if they are job, so will think the sun shines from the bailiffs anus, unfortunately. The poor woodentop will have a nasty shock when they have been party to blackmail and possible fraud. they will be mortified. In the meantime kim must allow Celestine to progress this to the CEO of marstons, and seed if reason will prevail.

                    No I didn't get a receipt for the car. The police woman took me to my car to empty it then I handed the keys over to her.

                      No they didn't tell me when he would collect it but they have taken the car to the police station.

                      I haven't made any payments. I tried to make a payment last weekend but when I tried I couldn't as Marstons had removed my account details and my reference number didn't work

                        In that case complaint to the MOJ and your MP, as marstons have prevented you from making a payment, as to the copper, you need a reciept so complaint to Chief constable and the Commissioner for your area.

                          There are two attitudes in the police or "the police service":
                          1. One type of officer joined to help the public and to try to prevent crime as much as possible; they are generally helpful and approachable.
                          2. Another type of officer thinks he (or she) joined the "police service", which they perceive to be there to control the public and generally to act rather like an army of occupation; rather than being helpful and approachable, they are usually truculent, officious and have a grossly inflated opinion of their own abilities and/or their lawful powers.


                          What the latter type of officer seems unable to understand is that their attitude rather deters the public from volunteering information that may help to prevent crime or to catch miscreants. Worse, unless the overall public perception of the police does not improve, the public will be less likely to protest when the current police privatisation pilot with G4S is extended nationwide.

                            All members of Bailiff Working Group and Celestine PM'd and asked to look in on Posts 103 and 104.

                            Looking at what the Muppet from Marstons has done, I have identified the following offences -

                            Fraud by False Misrepresentation
                            Making A False Report to Police
                            Perverting the Course of Justice (links to above offence)

                            The Suffolk Police plods have probably committed the following offences -

                            Aiding and Abetting Fraud by False Misrepresentation
                            Being An Accessory to Fraud by False Misrepresentation

                            and the following civil torts -

                            Unlawful Seizure of Property
                            Unlawful Deprivation of Property (Protocol 1 of Article 1, Human Rights Act)
                            Unlawful Detention of Property
                            Wrongful Arrest
                            Unlawful Detention
                            False Imprisonment

                            I'm a little wary about levelling Blackmail at either the muppet or the plods from Suffolk Police. Unless I'm missing something, do we have an unwarranted demand and use of threats as a means of enforcing the demand? If we do, the Blackmail offence has legs.

                            As to what Suffolk Police should do to redress this sorry state of affairs, the best thing they could do is seize Kim's car from the bailiff or whatever mug now has possession of it, then nick the bailiff. However, I would not be surprised if the bailiff was given a good hard slap for putting the plods in such a situation in the first place before he arrives at custody.
