    FMOL, freeman On the land, try to use common Law arguments to trump statute, and will use the idea of the Law being perverted with maritime Law, such as the term Dock, the Strawman created by the Be(i)rth certificate, which is the legal entity rather than the living Human being, they will counter a bailiff by claiming that the bailiff has no power, because they have no contract with the bailiff.

              Thank you, I have read through this. I am having the same trouble verifying the bailiff in my case is registered. He does not appear on the register and when I called up they could not ind details for him. The court are unwilling to help when I called then to check so feel like I am at a dead end checking his registration as a bailiff for now. I have today sent a email requesting information of his certificate. I hope to hear something soon

                What is the bailiff enforcing? It is illegal for any person to levy distress when not authorised to do so under the Distress for Rent Rules 1988. In certain circumstances, it is also an offence under the County Courts Act 1984.

                  Hello bluebottle. The bailiff is enforcing a unpaid magistrates fine. I have been trying to ring the court again this morning to ask some questions about my car but it is permanently engaged. I am terrified to stay in my own home because of all of this and find myself going out all day. I will have the money to pay the fine on Saturday but until then I feel like I need to stay out of my home as the bailiff is due any time

                    In the first instance, you need to speak to the HMCTS Area Enforcement Manager (AEM). If you get no joy there, escalate this to the HMCTS Regional Contracts Manager (RCM). If this becomes unpleasant, come back onto this thread.

                    Just for reference, who is your local police force?

                        I have just had suffolk police on the phone and they said the bailiff has reported my car stolen and I could be arrested for theft of a motor vehicle. What will happen? I am waiting for the policeman to call me back about this.

                        I am so stressed and upset over all of this.

                          Are you sure it was Suffolk Police? Bailiffs are known to make intimidating telephone calls, posing as police officers. If the bailiff has done this, he has committed an offence for which the police can arrest him. Also, if he is not currently registered to act as a bailiff, he is also committing an offence for which the police can arrest him. Check that it was, in fact, Suffolk Police and not Mr I M A Scumbag the bailiff.

                          You cannot be arrested for Theft on the say-so of a turd-brain who, it sounds, is desperately clutching at straws or seriously taking the p*ss. If the bailiff has made a false and intimidating call, that is serious. It is not only a criminal offence, it also brings into question his fitness to act as a bailiff.

                              It was a policeman as he left a voicemail an I called him back through the police station. I have explained the situation to the policeman and he is saying he will try and come to some kind of arrangement with the bailiff about all of this and call me back and let me know what he said. The bailiff came here this morning and realised the car had been moved and called the police and reported it stolen. I told the policeman I am not refusing to pay but can not pay all in one go and explained my circumstances. He was quite sympathetic with me and said the bailiff said the charges would be dropped if I paid in full.
