    Why were you arrested?

    One can certainly understand how your choice of language could have been most offensive to a woodentop who had spent his career being a big creep, but the reason given for your arrest might be important were you to claim compensation for wrongful arrest or false imprisonment.

        Suspicion of cannabis,i told the officer countless times it was a rolly (tobacco) but he just wouldnt have it.
        when he started questioning my whereabouts was when i told him to F-off or arrest me.(Which he did),lol.

          You were in a no win there, he would have arrested you anyway, because he wanted to be dutti babylon after Da Man's 'erb, he was feeling ire Man, him tink he have a sure bust for da ganja.

            Just dradting letter to judge,not sure what to put.

            Dear Judge,
            may i ask your permission to appeal a order made by one of your lesser honchos on 1st March.
            Judgement was made in my absence,though i clearly stated i wanted to be present.

            N24 judgement gave no reasons for dismissal,could you give me some details why it was dismissed.
            Will then be able to write you a an formal request why my case should be reviewed or grounds dor appeal.

            (Second appeals to the court

            52.13

            (1) Permission is required from the Court of Appeal for any appeal to that court from a decision of a county court or the High Court which was itself made on appeal.

            (2) The Court of Appeal will not give permission unless it considers that –
            (a) the appeal would raise an important point of principle or practice; or

            (b) there is some other compelling reason for the Court of Appeal to hear it.)

              Sleepy - I think you might be advised to reword that slightly (take out honchos perhaps?) as some judges appear to be in negative equity on the SOH front x

                Today i am going to seek legal advice from a solicitor,this is way beyond me,i need some one who speaks there language.
                Contacted a solicitor who deals with traffic law he said my first hour would be free,going to see him this morning.

                Big thanks to you all for support and advice given.Will keep you updated.

                      Might he therefore have a valid claim for wrongful arrest, as he was plainly not arrested for being in possession of a big, woolly hat, for being in possession of black, curly hair or for looking at the policeman in a funny way?

                        CleverClogs, it would fall on whether the officer had reasonable suspicion in all the circumstances that Sleepyhead had a joint, and some prime ganja, so had a justifiable cause to arrest. A rollup smells completely different to ganja, so it could be the officer was being a complete anus, so would arrest on any excuse, he would be looking for enough ganja to ground an "intent to supply" rather than a single spliff. From that it may be that when no ganja was found he parked the motor in a penalty zone, in a fit of pique, the drug bust for the league table down the pan. I would say that they would likely take the side of the dutti babylon, having reasonable suspicion, especially if a CCTV operator reported it in.

                            The problem is that some CCTV operators can be a few sandwiches short of a picnic, which makes one wonder how they ever got the job. Also, don't discount boredom on the CCTV operator's part. I've seen the result of the actions of poorly-trained, ill-disciplined or bored CCTV operators. This case seems that it could be such a case.

                              Went to see local solicitor,gave him brief on where i was up to.

                              I got impression that he was just sussing out how much cash he could make from my case,then advised me that i should seek specialist advice and gave me name of solicitor 35 miles away.(session took 20mins)
                              He mentioned taking action against police,said i would get back to him.
                              Back to drawing board.

                                I'm afraid the legal eagle is correct, Sleepyhead. There are legal professionals who specialise in dealing with police blunders and misconduct and they are the best ones to consult. There may be a case for informal resolution, but my suspicion is the police officer may face disciplinary action over this. As for the PCN, the police may resolve this by offering to pay the penalty charge as it was one of their officers who was responsible, but that is something that needs to be discussed with a specialist solicitor.
