We have recently returned our car bought on a PCP under voluntary termination. We had paid more than half the value of the agreement, we had paid 32 of the 37 payments under the agreement.
My husband was present at the time of collection by an auction house who examined the car with my husband and a form was filled in with agreed damage to one alloy wheel and a small scratch. This form was signed by the auction house collector and my husband. Unfortunately we did not take pictures as we felt the form was sufficient. There was also excess mileage of 5826 over the 21,000 miles agreed at time of purchase.
We have now received a bill from the finance company charging us for 8096.27 miles pro rata and charges for damage to 4 alloy wheels. My husband spoke to the finance company with regards to this as we disputed the charges and spoke about the form that was signed by the collector and my husband and they informed him that the form is irrelevant and they are only going by their report which we were not present to witness.
We do not understand the excess mileage charges as how can they charge us for 8k miles when we have only exceeded by just under 6k and is the form that we signed a legal document?
