  • Received a Judgement for Claimant (in default) but no claim form.

    Hello - first posting.

I have received a 'Judgement for Claimant (in default)' notice from the County Court Business Centre. It tells me that I have not replied to a claim form, but I have never received this form to respond to.

So, having not been given the chance to fill in the form, I now have a Judgement against me.

This is for a legacy credit card debt with MBNA from over 10 years ago. We've paid a small monthly amount to various debt collectors over the years, but it was recently acquired by Arrow Global, who then instructed Restons Solicitors in Warrington to pursue the claim. (I've been reading some bad things about this company, but only since I've received this Judgement).

Is there anything I can do to complain about this? I phoned the County Court Business Centre and they said that it was definitely sent out to me. But if it hasn't arrived, what rights do I have here? They simply recommended that I try to arrange a monthly repayment scheme with Restons, so it seems that as far as the court is concerned I have just failed to respond, whereas in fact I haven't been given the opportunity to respond!

    Any advice gratefully received,

    Kind regards

    Steve
