  • Half way rule vehicle finance

    HI, I am hoping someone can help. Its a long one so stay with me.
    I purchased a Nissan Qashqai in Feb 15 on 36 mths finance with The car finance company paying £365 monthly. All was going well until my Daughter suffered an illness that left her with a brain injury, this meant my wife quit work to care full time for her. I contacted finance company to explain the situation and they reduced our payments to £170 mthly as worked out on our income and expenditure. Again this was going well for the past 10 months until they contacted us to say we now have to pay the full amount again plus arrears, I explained that our Daughter is still unwell and our income hasn't improved' they said we no longer can accept these low payments and you must pay £450 mthly until the car is paid off which would be early 2018 or hand it back, I asked what would happen if we hand it back as we are past halfway and the man told me nothing. you hand it over and don't pay arrears.
    The next day I call again to say we have no choice but to hand back and this time I am told we have to pay all arrears and fix any issues etc once it has been sent back.
    I now know this to be true but am annoyed at the wrong information given, they didn't believe me and went back to listen to the previous call and came back and apologised and said a manager will call that Monday, he never did.
    Ok so we make two payments at the higher payment asked and then cannot afford to put a new tyre on the car and it is now due ant mot. We have no choice but to return the car, so we are about to send the letter, what I would like to know is do we have any right to return the car needing a tyre and mot if they have forced us into paying so much monthly without doing income and expenditure that we couldn't afford the upkeep?
