  • Tomlin Order only a few days old and its been broken already !!

    Hi all New here so please bare with me.

    A Tomlin Order has been in place since the 27th April 2017.

    It was a joint order to stop my neighbor doing things to my land and vice versa.
    One thing was and I quote "If any works need to be carried out on the boundary then my neighbor has to give me 21 days notice in writing with his intentions and not to undermine our property in any way shape or form.

    Point is, he has done some shady stuff over the years and it involves our property, so to stop him doing what he likes he agreed to this as well as us.

    Over the bank holiday (knowing we were away from home for the weekend). He decided to start erecting fencing on the boundary of our joining properties.

    The order was only 2 days old and he has broken it already? Not to mention he trespassed on our property in the meantime and also undermined our property to concrete fence posts in situ without 21 days notice.

    What should be our next step? And what could be the outcome?

    Anyone been down this road? If so any information would be greatly received.

    p.s We have already remortgaged to pay for solicitors fees etc. This time the shoe in on the other foot. We knew he would not stick to the order, but this time he will have to pay out for his solicitors as we made sure we were covered this time. Fingers crossed.
