  • 2nd bank charge on a buy to let

    hi there,

    I have a second charge on my buy to let investment from a business bank loan with HSBC, there are demanding full payment of this second charge after a long winded period of trying to negotiate, my question is can they force the sale of this property, my main lender has said no as long as payment are up to date which they are.
    my question is if sold, they would take out the amount from directly from the acting solicitor of the sale, would the whole proceeds be subject to capital gains tax before they took they amount or after?

    the history was originally 89k which was negotiated down to 35k, which 4k was paid, but due to divorce this stopped me from settling as planned, they have asked for an offer to settle only to come back to me saying they would only settle for the full amount 89k intimating that that they haven't charged me interest......yet.

    I have offered 50k from the sale of my matrimonial home, 23k from another freehold lease extension if they release that charge and the balance over 1 year, this has been turned down.

    my case is being handled by a debt collection agency on behalf of HSBC

    I feel that a gun is pointing to my head, I have been trying to negioate for over a year now, draining and depressing with divorce is an understatement
