  • Disputed mortgaage shortfall debt

    Hi,

If you have mortgage shortfall, you have disputed this debt the original lender sells the debt to a DCA, the DCA agency says they will pursue you legally, they don't. After 6 year's the DCA sells the debt on to another DCA and now they are chasing you for the full amount.

Just to make sure this is enforceable by the new (latest) DCA, can I ask to see a copy original agreement? should this be the application form or the actual mortgage offer with details of mortgage amount being given with interest rates that are being charged?

I just feel this new DCA is now trying to collect the full debt but not sure if they legally can.

Is there anything I can ask for from the DCA to show they are now the full legal owners and can take me to court to enforce payments from me. They have sent me a notice of assignment but nothing else. The notice of assignment was sent by this new DCA but was on headed letter paper from the pervious DCA. It took them two months since the assignment to send me the first letter.

    Thanks
