We need help with a claim from our old landlord and also a counterclaim for over paid rent.
The claim is for
1 Unpaid rent for rest of tenancy
2 Loss of holiday let rental follwoing end of claimed tenancy
3 Claim for damages and replacement of items in property
1 unpaid rent £2000
landlord gave us verbal notice but has now claimed tenancy was for a fixed 3 year period.
She has supplied a tenancy front page to court showing 3 year tennancy but we have the tenancy front page that shows a 12 month tenancy, we have lost tenancy agreement but got a copy of front page from council that we supplied to claim housing benefit.
Landlord now also claims she told us verbally tenancy would not be renewed at the end of 3 months. She has admitted in ourt papers that she allowed us to leave early if property was suitable for immediate rental when we left. She did not say this but this is her claim. We gave verbal notice when she came round to tell us she was giving us notice in April 2015, us such we have taken a four week period following our notice (4 weeks following the next payment due date of rent).
2 Loss of holiday let rental - £1,500 -this appears to be a claim for 2 weeks holiday let - property was holiday let before the tenancy.
3 Claim for damages, replacement of items and work in property
Cleaning sevices - £300
Replacement woodburner - £825
Replacement, repair and replacment of kitchen furniture doors -£1,757.09 this quote inlcudes tiles, new built in oven, new under counter fridge and new ktchen cabinet doors. Quote for supply notfitting.
Tree services -£400 - chipping of branches and removal
Sewage removal - £180 - septic tank on property
Total claimed £6,962.09
Two ppoint on damages - landlord has sold property in May 2016 but is still persisiting with the claim going to court, No inventory and schedule of condition was carried out at all at the start of the tenancy nor at the end. Certainly this was not supplied to us and in the claim from landlord to court it was not prpduced
Counterclaim is for overpaid rent based on claendar month rental of £500 and a weekly rent paid over period of rental of £125/week.
