  • Court action from Howard Cohen on a statute barred debt

    Hi there,

I have received court papers today issued by Northampton regarding an old credit card I took out in 2004. The account was defaulted in Feb 2006 and has been passed from DCA to DCA over the years.

I sent a CCA request many years ago and was sent a letter saying they were unable to supply the information requested so the debt was unenforceable until they were able to do so.

The DCA (Robinson Way) then started sending letters on a weekly basis from about Dec 2015. I again sent them a CCA request and again Barclaycard wrote to me saying the same as their previous letter - it was unenforceable.

The default fell off my credit file in Feb 2016. I then receive this paperwork this morning.

Is my defence that it is both unenforceable and statute barred feasible. If so, how do I go forward.

    Many thanks,
    Suesueb
