Hi,
Despite further delaying tactics, a 'Detailed Cost' hearing has been arranged.
The paying party has attempted to derail this process on this occasion, citing a spurious application to the Court of Appeal, which so far has been sensibly ignored.
C.P.R. rule Detailed assessment is not stayed pending an appeal unless the court so orders.
So my question is this;
If the paying party fails to attend this hearing, Is there a procedure for avoiding further nonsense, and directly requesting a final decision on this matter.
The Court is now in possession of all the relevant paperwork to make such a decision.
Also with regards to recovering the additional 'Costs' relating to this 'Detailed Cost assessment'.
When am I required to submit these expenses, as until a decision is made, these Cost will obviously increase with each further hearing or development.
And finally, at what rate should interest be charged (8% ?)
Many Thanks
