  • Enforcement officers and ccj

    Hi,

I was running a pub until December 2022 and sadly a pub that was doing really well, starting failing after Covid and. I left with about £30k debts. It’s been a hugely stressful time and at the same time my marriage ended so there was a lot going on! Anyway I have never got into debt so didn’t really have the first idea what to do but ended up going onto an IVA. One of the debts never got picked up though and long story short, a few weeks ago I got a letter to my home address with the pub name on which rang alarm bells. Basically I had a received a ccj and a letter from a debt collection agency. I was stunned by this that a) it had gone this far without me knowing and b) that there were now enforcement officers involved. I spent the following day on the phone to them and calling the court to see what my options were. I had to send them an email to set up to stay the writ and set the judgement aside. I then phoned the debt agency to tell me but the following Tuesday an enforcement agent turned up at my house and I paid the balance plus £800 extra through fear of more money being added on. I have complained to them because I made it clear to them I had no prior knowledge of the process and feel that I was deliberately did not inform that there would be a huge amount added on if an enforcement officer came out, my point was clearly I would have paid the amount on the Friday if it had been explained to me the £800 would be added on by the Tuesday. They came back eventually saying that their letter explained there would be add one but when I spoke to them I feel they should have earned me and not just said an enforcement officer will discuss it with you. I found the whole process extremely upsetting, misleading and I have lost money I am not in a position to lose. Do I have any options? Thanks if you read the long, boring post!
