  • Private parking management company court claim

Hi, Can anyone help me? I am being taken to the small claims court by a private parking management company for unpaid PCNs.

I have received the Directions Questionnaire from the company's solicitors (refusing mediation), but I haven't yet been sent a questionnaire by the court to fill in myself. I have never received the two PCNs listed in the Particulars of Claim (there are no PCN numbers given, only the dates). I have had no reminders and no Letter Before Claim.

I submitted a Subject Access Request to the parking management company for the original PCNs and for other information about the signage but they have refused to give me any information. They advised me to contact Debt Recovery Plus for details of the PCNs but I have had no response from them.

The PCNs were issued while my car was in my own private parking bay outside my flat on the grounds that I was not displaying a valid permit. I am defending the claim on the grounds that the terms of my lease agreement give me right to park in that bay and my parking there has resulted in no loss of earnings etc. My question is: Can the parking management company ignore my Subject Access Request and refuse to provide me with the original PCNs and the information that I need to defend the case?

Also, I have had three separate Letters Before Claim from the same company's solicitors for a total of seven further PCNs - all while parked in my own private bay. I do have the original PCNs for most of these. I appealed each one and each time the appeal was rejected. My question here is: Are they able they bring multiple court cases against me? I'm feeling out of my depth and can't afford to consult a solicitor.

Any advice or useful information would be much appreciated.
