I purchased a vehicle through a private sale 3 1/2 years ago. I've come to sell it now and its classed as a category B write off, I know I will struggle to sell it because of this.
It was made in 1996, written off 1996 as well. I found out it was category B write off from doing a HPI check. The DVLA are not aware that it is a category B write off (as they shouldn't issue a V5 for these vehicles). The insurance company that wrote it off in 1996 has comfirmed that they wrote it off but can't provide any more information due to many upgrades of systems since then.
Since I've owned the vehicle its always been insured, taxed and MOT'd with no issues and nothing raising anything to say it was a category B.
Where do I stand with this, do I have an argument against the insurance company that wrote it off for them not informing the DVLA?
Any advice is appreciated as I am struggling to find much information online about this issue.
