  • Unable to serve notice of claim? What would happen next?

    Good Morning Everyone

    Just a quick question...

A couple of weeks ago a friend I used to stay with in Aberdeen said that the postman tried to serve what would appear to be a notice of claim form... he explained that he would not be willing to sign for this as I had not stayed there in a couple of years and he was not in contact with me anymore.

As it happens he manage to make contact to alert me to this... what would happen next? Could this action still go ahead and they get a default judgement? Surely this would not be the case as they have not formally served this and a signature with Royal Mail would be required to show this?

I have no idea what company this would even be served from... and surely if they wwentahesd with action... if a decree was granted I would be able to get this recalled and counter claim for damages as they falsely served this notice?

    Just curious about these facts.

    Thank You in advance!
