  • Declaration of trust

W had a house purchased under 'right to buy'. 3 of his children contributed to the purchase price (W had the smallest share); all 4 were tenants in common, but W only lived in the house ("in possession of the land") A declaration of trust (DoT) covered the percentage shares & how the money was to be divided upon the sale of the house. The DoT did not state that W was the only person responsible for the cost of maintaining the house. When W died, the house was redecorated & re-carpeted, with W's estate bearing all of the expenses. Is this a legitimate liability to W's estate?
