  • CCJ Set aside Request advise

    Please I need your advise. I had a CCJ back in December 2015 which I did not know about for some months until 2017. I had a credit card from vanquis with limit of £1500. I was contesting with them regarding excess charges they added to an amount pf £2,243.75. I send them letters to negotiate the real amount and did not received feedback.

    I actually had credit in the card and balance of about £800 before they stop sending me renewal new cards. I had very difficult financial difficulties in 2013 to 2016 including housing issues. In 2013 I made SAR to try and arrange payment with the real credit amount of £1500. But nothing received.

    Lowell Portfolio succeeded default CCJ of £2,794.56. They requested attachment of earning last year and I starting paying towards it at £20 per month. I closed the account I set standing order due to online fraud I encountered and forgot to reset the £20. They have resend attachment of earning to me and my previous employer because I missed 2 months payment.
    But for some unexplainable circumstances I received the SAR made in 2013 as re-mailed to me in my current address, originally posted to my address I lived in 2013. I have checked my previous emails with vanquis as well.

    My question is that: Base on the current information, can I request the CCJ to be set aside and contest the CCJ now with my evidence as the real amount was £1500 and not the amount they have entered me into CCJ.

    Any advised is most welcome.
