  • Hi - a plea for advice re CCJ set aside hearing

    Dear all,
    I am hoping to get some assistance from you kind and wise lot regarding a hearing to set aside a CCJ.
    I have a court hearing by telephone next month.

    For background, I was given a CCJ after all paperwork relating to the hearing was sent to an address I had moved out of more than a year earlier.
    I am on the electoral roll at my present address and had been for months prior to the court hearing taking place.
    I only learned a CCJ had been issued in my name after I checked my credit file, two months after the hearing took place.
    I have since repaid the total amount owed. The money was to a debt firm which had picked up a debt relating to a payday loan from a number of years ago.

    The company which I owed the money to has said to me it will not oppose my application for a set aside, now I have repaid in full.

    The court has asked I prepare an electronic bundle for the judge and other party - the payday firm - ahead of my hearing.

    I am looking for advice on what should be included in this bundle please?

    My initial submission on the set aside form included my argument that I was not resident at the address where the notification of the hearing was sent, or the outcome, and I had no chance to represent myself or repay the money before I was made subject to a CCJ and I would have repaid in full had I known.

    Any help greatly appreciated!
