  • Cabot and CCJ

    Hi

I'm really in need of some help. I have been being chased by cabot for a debt on a car loan that I took out in 2000.

I wrote back to them believing that it was time barred because I hadn't heard from them for a number of years.

I had a visit from a debt collector today but no reply from cabot about the time bar claim. I looked in the letter box after he had gone to find that cabot had sent a letter stating that a ccj was issued in 2014 for the debt and it was timed to coincide with the debt collectors visit.

It appears that the last time I made payment to them was for £11 in 2009 and so in fact the debt was not time barred before they obtained a ccj.

They are now chasing me and visiting my home.

I did not receive the court papers for the ccj because I had gone through a messy divorce and rented my house out from 2013 to 2015 when I sold it.

In addition, when I defaulted on this debt in 2002, the loan company sent round 2 rather large gentlemen to seize the car and told me that they were taking the car as payment for the debt to sell.

The company did not send me any information about the sale and so I assumed that the debt had been satisfied.

Cabot took the debt over in 2007 and I didn't receive anything from them from 2002 until then. I paid £55 to cabot in total to stop them visiting my house in 2009 but heard nothing from them after that.

What can I do now? The debt is for £6180.22 and I just don't have that kind of money.

The ccj doesn't appear on my credit file which is why I had no idea.

Any help and advice would be appreciated.
