  • Bailiffs attempt to recover a debt already paid - breach of data protection laws?

    The background: I received a parking charge notice, issued by a parking company four years ago. Legal proceedings were commenced and a default judgement was handed down (a long Covid-related story), together with an order to pay £185.

    I paid by as ordered by cheque and within the prescribed timescale, keeping proof of postage. The payment was processed nearly three weeks later, as evidenced by my bank statement.

    A few weeks later I received a letter from a bailiff company, informing me that the debt was 'unpaid' and I was being pursued for an inflated amount.

    i immediately contacted this company by phone and pointed out that the debt owed to the parking company was settled in full. In return I was advised that a note to this effect had been placed on my file.

    This should be the end of the matter as far as bailiff involvement is concerned, but it raises the question: by passing my personal details to a third party without reasonable cause- I've made an SAR to the bailiff to determine how much information is held- has the parking company breached data protection laws? If so, then a complaint will be made to the ICO. Regardless of the outcome, would legal redress be available to me?
