I am hoping someone can guide me on how best to construct a letter to pursue a negligence claim against a firm of solicitors who deducted money from me during the process of a re-mortgage and failed to pay off an equitable charge on my property, if only it was that simple.
here is the background to the story.
1993 equitable charge on my property made the in favour of a company for £1600
2007 I re-mortgaged my home and instructed a firm of solicitors to carry out the legal side, which included the repayment to my existing lender and the charge on the property which must also be paid off.
2019 I put my home on the market to sell and secured a buyer. It came to light that the charge was still on the property.
I contacted the solicitors and was told they went into administration in 2014 and it came to light that this firm had misused funds within the company.
The administrators told me they had no paperwork regarding my case due to the length of time and stated that I would need to made a claim to try and retrieve my money back.
I have again paid £1600 to the creditor and they are in the process of removing the charge.
I know what to try and claim back the £1600 and not sure how to construct this type of letter.
