Hello. I asked about this a while ago but got no replies.
We are doing a section 75 claim for a Shepherd's Hut which was built very badly and was in breach of contract.
We withheld some of the final payment (£3,500) from the builder at the time. We paid £12,200 in total.
The builder is disputing the breach of contract. He is now saying that we do not own the hut, he does.
We are renting out the hut as a holiday let as it is structurally sound, it just doesn't contain elements we paid for, e.g. a woodworking stove and the windows and doors are dreadful, but do work.
He a now saying he is going to stop us renting the hut out as it belongs to him. He says he is going to send a cease and desist letter.
We have had independent verification that the hut is badly built. We are actually closing it down in October for repairs to be done before the winter.
We are really confident about our case, but we are not sure on the ownership issue? Who owns it? Thanks for any help!
