    Hello all,

    My partner is looking to make a wayleave claim for an electricity pylon situated in the garden of the house he jointly owns with his ex. She has lived out of the property for 2.5 years and does not contribute to the mortgage or any other house related costs and hasn’t done since she left. She’s still on the deeds as my partner is not currently able to remortgage on his own as a result of missed payments several years ago. Things are civil and the eventual plan is to remortgage. Anyway, the question is, in order to proceed with the claim, or if the claim is successful, will the ex have to give permission or sign anything, or even know about it? Perhaps selfishly so, my partner is hoping for the total amount to be his so that he can use this towards a deposit for remortgaging. I wasn’t sure if that because she’s on the deeds she will have to sign legal paperwork etc.
