  • CCJ Claim from Private parking company

Hello, I'm hoping for some help! I received a county court claim regarding a parking notice I received back in November 2015 on behalf of OBS from DCB legal. The background is, my old place of work (which has now been demolished and is flats, and the company doesn't exist anymore) had.a car park that was managed by OPC (now OBservices I think). I had a valid permit that was displayed on my dashboard, but had slipped down slightly. If you was looking at my car from fairly close range, you would be able to see it. Anyway, despite this received a ticket. I sent them a picture of my car, a picture showing where the permit was, and a picture of the permit itself making it clear, I was not going to pay this fine as my 'appeal'... and this was denied. There reason being, it wasn't 'clearly' displayed, and the operator is under no obligation to search for the permit in the vehicle. They sent photographic evidence of this, in which you could not see anything clearly. They had taken pictures of my car, which was under a tree, so all you could see in the windscreen was the trees reflection. I replied back to this stating the photos are not clear, you cannot see if my permit is visible or not. - They sent back the same pictures, just bigger, and a response to say I've reached the end of the appeals process. Fast forward nearly 5 years, I received a notice of claim, to which.I replied saying, as per my response in 2015, I had a valid permit and requested all documentation and correspondence they have regarding this matter in preparation for court - DCB did not respond. I did receive a ccj claim about a month later (4th April). *I wrote to both parties and have received all documented correspondence since 2015 from OBService. I have filed a acknowledgement of claim, but need to submit my defence soon. My big question... Do I have a good argument and how do I word my defence? It's all pretty daugnting. Any help would be appriciatedh6.
