I am currently in the process of preparing for a final hearing for Discrimination during recruitment by age and Disability.* Representing myself.*
Witness statements have finally been exchanged,* after a very long disclosure process which despite the respondent withholding documents it had in it control, and several missed CMOs and instructs by the court.* I still don't believe the CMO to be met, but have come to the conclusion it shouldn't effect the strength of my Discrimination claim, and this continues to show the respondent in a bad light.
I however was expecting the respondent to have called more witnesses 5 (not 2), given they are central to the case, and referenced throught the bundle.* The respondent had already been told off for calling the wrong witness at the preliminary.
So the question is can/should I request them to be called as witnesses by requesting a order from the court.
The organisation has constantly failed to follow its own policies, ACAS, Equality and charity governance.* I am at a loss at what their defence is, as it appears to just deny everything and hope I go away.
I'm also extremely disappointed by the constant failure of meeting CMO and* deadlines, and that the ET completely disinterest in making sure it was met and forcing the consequence of non compliance.
