  • Failure to pay PSC notice period

    Hi, I wonder what fellow user's opinions would be on this...

    I work (or worked) via a personal service company for an employer part-time and was laid off yesterday by phone (despite the contract saying it's only valid in writing). My contract states:

    "The Company may terminate this agreement at any time by giving the Consultant Company not less than 30 days’ notice in
    writing. The Company shall be under no obligation to provide the Consultant Company with work during any period of notice.

    "This agreement will terminate automatically without any requirement for notice or payment in lieu of notice in the event that the Locum shall die or become unable to provide the Services by reason of permanent incapacity or loses his professional registration.

    "The Company may by written notice summarily terminate this agreement with immediate effect if the Consultant Company or the Locum:"* *and lots of obvious reasons to terminate contract such as bribary etc.

    The company laid me off yesterday by phone (despite the contract saying it has to be in writing) and are now arguing that they don't have to pay me anything at all for the notice period as the contract says they are not obliged to offer me work during the notice period, and I only get paid for days I work.*


    Can anyone advise on the legal position here please based on the above wording of the contract?
