  • Restrictive Covenants

Hi i am litigant in person representing a myself and 45 other employees with an employment tribunal. I have someone that is happy to give a witness statement but they although they are a former employee having recently left the business they signed a restrictive covenant preventing them disclosing information about the business or the way it operates. Does the fact its contributing to a legal process override the restriction or could they still be subject to legal action if the business wanted to pursue that?
