  • Statute barred English/Scottish law

I have received a letter stating I owe money for an old credit card for which a CCJ was applied in 2018 in Northampton CC. However I have been domiciled in Scotland since 2016 and have been made aware that after residing there for six months Scottish law would apply in respect of debts. Can someone confirm if this is correct? I was unaware of the debt or CCJ as I never received any court papers or was given a chance to respond. The debt itself defaulted in June 2014 and so according to Scottish law it would be statute barred from June 2019 if I’m correct?*
The debt company who purchased the CCJ are arguing that they can enforce it and put a charging order in my home. I have advised them that it is not possible to do that while I live in Scotland as charging orders do not exist here and that they have not applied to the Scottish courts for a decree. They still deny all of that and state they can enforce it. I have not acknowledged the debt and no payments are showing on my credit file prior to June 2014.

I would be grateful for advice on this and how to respond as I believe they are acting illegally and that the debt is Statute barred due to my being domiciled in Scotland.*

    Thank you*
