  • Breach of indirect contact by the person who applied for it!

Please could someone enlighten me on any personal experiences with a similar situation:

Cutting a long story short - BM lost contact with child through neglect, drugs and alcohol misuse, inconsistency and failure to provide a safe environment for a child. Eventually the matter got taken back to Court after a number of years. BM suddenly decided she now wanted contact again. A lot happened in between but I will stick to the main facts. The court granted indirect contact only. Once a month by letter or card only. To be sent at the start of every month.*

Within the "recitals" it states that if this is consistent (and a few other factors) - after 6 months - direct contact may be considered.

Well - the other factors have not been done at all AND contact has not been consistent. It arrives either at the middle or end of the month (was clearly stated to be sent at the start) and sometimes not at all.

If BM decided AGAIN that she wanted to apply for more than this (direct contact) - is there any way that this could be granted given the fact there is proof of further drug and alcohol misuse and inconsistency? Unfortunately, this is highly likely to happen (when she gets bored of current partner) AND is very good at lying to authorities to wriggle out of situations!!! (always an excuse for everything).

Any thoughts would be greatly appreciated.
