The results of a recent Subject Access Request [SAR] from the council did not produce any documentation relating to financial matters, yet in 2007 the council in question put a charge against my parents' house as I considered my father was eligible for NHS Continuing Care and therefore not liable to pay for care home fees. In the event they took all his money he received on a weekly basis [pension etc.] and billed me for the balance - which led to the invoices being sent to me as joint owner of the property.
Does the absence of any documentation mean that the 'debt' has been written off given the charge was levied in 2007 and the last communication from the council's finance dept. was in 2009 when I told them I was continuing my appeal against the charges. The last time I heard re: the appeal was 2014. Of course in the period from 2007 there have been numerous changes with the legislation regarding NHS CC.
IF the debt is still extant - does this mean the council could have continued to levy interest charges and if so, are they not obliged to keep 'debtors' updated as to the running total?
If anyone has any experience of a similar situation I would be pleased to hear of same.
