  • Lied on planning application

I live in an apartment in Scotland , we own our house which has a garage driveway and small shared garden with our downstairs neighbours, the next door neibour to the left of us has a wooden shed joined to our garage which came with there house .

They have applied for planning permission to make a coffee roasting and distribution facility, theres a few issues here there shed sits next to our 7ft 200yr old boundary wall which they want tp knock an 8ft hole in to make a double door into there shed

We objected in planning saying the boundary wall was ours and in our title deeds , we didnt want a coffee facility 10ft away from our front door either.

This was at the beggining of the year , planning was granted in Feb regardless to our objections and the down stair neighbours objections.

4 weeks ago they started knocking down our wall with no permissions from either us or our neighbour below.

*Council was called and they sent building control to see how safe there coffee roasting facility was.Building was shocked , in the plans the building was down as a brick building not a wooden shed, it was a fire hazard , so told them to write new plans , also looking over there original application they have lied on several occasions, they said they approached us for permission when they didn't, they lied about amount of coffee being roasted , 5kg of deliveries each 3 months lol yet roasting 10hrs a week which is about a tonne a week.Lied saying they would be no need for waste disposal. And also lied to the architect saying they had ownership of the wall.

The planning say they have been no breach of application yet we can clearly state they have lied on the application. Planning passes us to building, building passes us to plannimg and no one seems to take any responsibilities? It clearly states on the application if any informatuon is incorrect the application will be void. We have now sent a solicitors letter to our next door neighbours stating the wall belongs to us and the solicitor has looked at there land registry which says they have no rights in the least to it , cam they rectify the wall back to its original condition.

Im shocked this has been allowed and its now costing us 100s and possibly more if we need to gp to court for some idiot to knock our wall down , yet no one seems to want to take responsibility.
