Hi everyone. I'm a first timer and have recently initiated the VT process with regards a PCP agreement with Volkswagen Financial Services and am finding the experiences posted on here greatly useful and encouraging.
I have used the VT template "Notice of Voluntary Termination with immediate effect" from the Vehicle Finance forum, which VWFS accepted and the car has been returned but I got the expected excess mileage charge from them approx 2 weeks later, 25000 excess miles (£1700). I immediately responded using the template letter "Response to finance co. disputing excess mileage charges" but got an equally quick response back from VWFS customer resolutions dept telling me my complaint had been rejected quoting CCA Section 99(2) stating “termination under subsection 1 does not affect any liability under the agreement that has accrued before the termination” and that the excess mileage charge remained due. They pointed out I could complain to the Financial Ombudsman but VWFS were unable to uphold my complaint. Their response very much looked like a template of their own as it was in the same format and used almost identical wording as I have seen in attachments to other threads in the Vehicle Finance forum. I have replied again challenging their decision, again using template letter "Response to finance co. disputing excess mileage charges" and am in the process of raising a complaint via the FOS using the FCA complaint pack that I found a link to in the thread “Copy of transcipt of Mercedes-Benz Financial Services (UK) Limited v Cahalane”.
That’s where I am currently up to but if anyone thinks there is anything else I should be doing, or even if you think I am being daft challenging it given the high excess mileage, please do advise.
