  • Access to Neighbouring Land Act - compensation

    Hi knowledgeable people.

I am clear as to the basics of the ANLA as regards when an order may be granted to give access to a neighbours property etc. What is less clear is what is meant by "compensation" for the property owner who is required to grant access. How is compensation determined? Specifically, if the affected property is rented out for holiday lets or longer term rental (and the building works affect the ability to rent out), would compensation include the loss of rental income? This seems a bit harsh as it is the property owner's decision to rent out the property (if they just lived in it there would be no question of such compensation).

    Thanks all for any thoughts
