PCP cancelled within 14 days / Car Rejected
My son bought a car on pcp -21 days ago rejected the car within 30 days
( day 2) sent letter to finance company broker and dealer. Cancelled PCP within 14days. Broker has told dealer they and finance company agree to a refund under CRA2015 backed up by ACE report that faults were present at fault of sale .Dealer is refusing to refund car ( finance company being very quiet except to say they will investigate my complaint within 56 days) . An ACE report was carried out ( partially as car wouldnt start) . Who is responsible for leading on getting the car back to dealer and getting the money from him. I have been invoiced for car by finance company - to pay within 30 days . Who should take dealer to court - and who needs to be doing paperwork in correct format to dealer. Dealer has said he is overdrawn to broker implying he wont pay even at court ..I want to return the car to finance company or broker or dealer as i have rejected the car - have evidence of faults ACE garage and DVSA reports . Do you take the business or named director to court ?? or can you cover it by listing both - he seems to start and disolve companies alot ??
