    Hi
    Hopefully you can help me as I have searched the internet and can’t find anything to help me move forward with a probate claim for my daughter regarding her late father’s estate.
    My daughter applied for her Dads probate only to find another application had been entered by his ex partner who had provided a will he had allegedly signed 24 yrs ago.
    My daughter entered a Caveat which is now permanent.
    The ex girlfriend provided this will 6 yrs after his death which claimed she was the sole executor and sole beneficiary.
    She served a warning which we responded to with an appearance on the grounds of undue influence and lack of capacity ... Her solicitor asked for evidence of my daughters claim , which we supplied mountains of.
    After receiving this , her solicitor has never been back in touch even though the last correspondence we had was to inform us that they intended to instruct proceedings to remove the Caveat.... That was 8 months ago !
    is there a process that my daughter can take to challenge the ex girlfriends claim regarding her application for her withdrawal from her probate claim that doesn’t include the costs of Court fees ?
    Can the ex girlfriends claim be removed due to a stalemate so as my daughter can continue with her claim ?
    We would be extremely grateful of any advice you may offer.
