  • Early PIP assessments

    Hello, I've just signed up to this Forum. I would be grateful for some advice. I was given PIP up to 12/12/16; but was reassessed in 5/16, and my PIP stopped then, with no notification, no report, etc. When I wrote to them to ask what was happening, telling them I had not had any information or a report, they wrote back, saying thanks for my mandatory request (or whatever it's called!), but it has failed, as I had not given any details of my report! They said I could appeal, but no details as to how. My husband looked it all up and printed off forms. They also lied - said they'd contacted my doctor (they hadnt, or my consultant), and lies again on the phone - (after I'd appealed) - said they'd changed their minds and were going to give me the mobility part of PIP. I said I'd wait for the court decision. The woman said she didn't know it had gone to court (I did it by non-attendance/paperwork). She then quoted from my doctor's letter - which had gone to court. When I pointed this out, she got in a fluster, said I wouldn't get any money then, and put the phone down. I appealed, it took six months (they even requested extra time, despite me saying we were struggling financially), but I got it back. The court (Cardiff) said it was up to 24/5/19. I received my renewal form on 24/5/18. I contacted the court, to say surely as a judge had decided that my PIP was up to 24/5/19, this shouldn't be allowed. They wrote back and said they couldn't deal with legal matters?! I also contacted the Disability Law Service, who said they couldn't do anything. They did, however, say you can still get your benefit whilst appealing, and DWP should have informed me of this? I had my assessment last week, which we recorded secretly. I told the Assessor that it was nearly six months early, which even she couldn't understand - I presume DWP want their bonuses for Xmas!
    ​​​​​​Can anyone clarify for me whether the DWP can ignore a court decision (if so, it rather makes a mockery of our legal system!); also if people can.still receive benefit whilst going through appeal? I have also developed mental health problems because of all this. Would i have any grounds for making a claim against them? As much as anything, I'm just sick of how they're treating people. Thanks.
