  • Cabot Financial and CCA documentation.

    Hi
    I am a new member and currently having ongoing correspondence with CABOT re historic debts. I have now requested CABOT for a CCA as I believe many of these debts have already been bought and sold since sold on by the original Bank in 2002. My question is If CABOt cannot provide the original documentation will these debts now be unenforceable but remain as an uncollectable debt.
    Any advice would be very helpful

    Indeed, if they fail to provide the documents under the CCA 1974 ( s.77/78 ) the debt will be unenforceable. This really only means they can't obtain judgment ( if you defend the case as unenforceable ) until such time as they do provide the documents.

    The CCA request will only apply to loans and credit cards though, not overdraft debts. Do you want to go through what the various debts are and what the original issues were. If they were sold on from the bank to Cabot in 2002?? they may be statute barred if you haven't been making payments on them.

      This is what I also believe about enforcement or not if Cabot cannot supply the CCA. My debts were for Credit Cards and I have been paying off these debts via a DMC for over 10 yrs....I know I should have taken out an IVA (but that is another story!.....I will keep you updated as I have again been in contact with CABOT and await a reply.
