  • Unenforceable credit agreement Cabot CCJ awarded need help with appeal Cabot

    Hi,
    Please help.
    Cabot Financial was awarded a CCJ for £7474 on the 28th June against me, however I know the judge did not apply the law correctly as Cabot sent me a very recent credit card agreement (Capital One) which was from 2006 onwards, my credit agreement was from Jan 2002 and this alleged true copy has a reference to the default sum being £12 which was introduced in 2006 as all credit card companies were deemed to be charging to much for a missed payment (default sum amount) so therefore I can prove it is not a true original which was received. Also the printed copy is illegible in SOME PARTS and the judge could not read it when I asked her too!
    I really need to know what law to be quoting and how to word my appeal as I can only see the Financial Conduct Authorities (FCA) handbook references www.handbook.fca.org.uk/handbook/CONC/13.pdf
    I also should point out that the claimant failed to give a breakdown of where the amount claimed had come from, interest and charges were not proven and no explanation of where they had come from was given. It took 26 months for Cabot to send the alleged agreement, so basically I think they knew they never had it from the start and tried it on.
    And further I have had no court papers in the post 15 days later!
